Vermont Lead Inspection & Compliance
Vermont's IRC lead compliance laws carry fines up to $10,000 per violation — and the Attorney General's Office is actively prosecuting. Kestmark is Vermont's dedicated lead inspection and compliance partner, launching soon.

Vermont's lead compliance laws changed significantly in October 2022. What used to be called Essential Maintenance Practices is now the IRC program — stricter, more enforceable, and actively prosecuted. Here is what non-compliance actually looks like.
The 30-Day Repair Clock Is Already Running
The moment a tenant reports deteriorated paint — or you discover it yourself — you have exactly 30 days to stabilize and repair it using licensed lead-safe practices. There is no extension. There is no grace period.
Vermont IRC Practices — 18 V.S.A. § 1759
$10,000 Per Violation. Per Violation.
Vermont treats lead law violations as consumer fraud under the Consumer Protection Act. The Attorney General's Office has actively pursued cases against landlords — not just for lead exposure, but for filing false compliance documents.

Unlicensed Renovation Work Is Your Liability
If any contractor you hired disturbed more than one square foot of lead paint without an RRPM license, the liability is yours — even if you didn't know they were unlicensed. Ignorance is not a defense under Vermont law.

Annual Filing Is Not Optional
Every year, every pre-1978 rental property must have an IRC Compliance Statement filed with the Vermont Department of Health. Miss a year and you are out of compliance — and out of the liability protection that compliance provides.

No Disclosure = No Defense
Before a tenant signs a lease, you are legally required to provide the EPA lead pamphlet, disclose known hazards, and provide your most recent compliance statement. Skipping this step eliminates your legal protection entirely.
Federal Lead Disclosure Rule — 42 U.S.C. § 4852d
Compliance Is Also Your Shield
Here is the other side: landlords who follow IRC Practices, hire licensed contractors, and file on time receive significant legal protection against lead-related lawsuits. Compliance is not just a burden — it is your most powerful liability defense.
Vermont IRC Safe Harbor Provision
"Guilty until proven innocent" is not a metaphor in Vermont lead law.
Vermont's framework assumes that pre-1978 properties contain lead-based paint unless a licensed inspector certifies otherwise. The burden of proof — and the cost of compliance — falls entirely on the property owner. Kestmark exists to make that burden manageable.
Kestmark is currently completing Vermont RRPM certification and training. The following services will be available at launch — built specifically for Vermont landlords, property managers, and homeowners navigating the IRC program.
Annual IRC Visual Inspection
The required annual inspection of all painted surfaces in your pre-1978 rental property, documented and filed with the Vermont Department of Health.
IRC Compliance Statement Filing
We handle the annual compliance statement submission on your behalf — ensuring it is filed correctly, on time, and with complete documentation.
Lead Hazard Assessment
A thorough evaluation of your property's lead paint condition, identifying deteriorated surfaces and prioritizing repairs before they become violations.
Pre-Sale & Pre-Rental Inspection
Protect your transaction. A certified lead inspection before listing your property gives buyers and tenants confidence — and gives you legal protection.
Tenant Disclosure Package
We prepare the complete tenant disclosure package required by federal and Vermont law — pamphlets, disclosure forms, and compliance documentation.
RRPM Contractor Coordination
When repairs are needed, we connect you with licensed RRPM contractors and verify their credentials — so your liability stays protected.
